The following words of Justice Tobi of the Supreme Court of Nigeria cannot be said any better. It is the writers view that the Independence of the Judiciary remains paramount to the existance of any meaningful polity. The actions of the Supreme court is laudable and indeed gives hope to the future of the legal profession in Nigeria.
"We are not members of the PDP and have no interest whatsoever in any candidate for the elections. I want to say here that court feels very unhappy with conduct of the counsel to the first appellant ... Alex Izinyon (SAN)... he will need another bench to hear this matter .We have given order in the matter. No panel can sit on appeal over its order ... good counsel is one who can accommodate defeats ... but to come that way to cast aspersions on us is most unfortunate ... I had to go to the office of Chief Justice of Nigeria (CJN) and read the order and CJN was satisfied. The motion withdrawn is useless and purely academic and it is hereby struck out "
