Lets talk a little bit about the potential pitfalls capable of derailing the forthcoming Nigerian Presidential elections. The case in point would be S. 37 of the Nigeria Electoral Act 2006.
According to Section 37 of the Act;
"If after the time for the delivery of nomination papers and before the commencement of the poll, a nominated candidate dies, the Chief National Electoral Commissioner or the Resident Electoral Commissioner shall, being satisfied of the fact of the death, countermand the poll in which the deceased candidate was to participate and the Commission shall appoint some other convenient date for the election"
This section of the Act therefore provides that elections are to be delayed until a convenient date if a candidate dies after nomination papers are delivered. Hence, under the electoral law, balloting may be postponed if the party requests a delay.
The pertinent question is: given the wordings of the Electoral Act, and the recent demise of the presidential candidate for the Alliance for Democracy (AD) - Adebayo Adeferati, would the provisions of S.37 of the above act act as a bar to postpone the forthcoming Nigeria Presidential Elections?
